General Conditions

(according to Chapter I, section 3, part 3, of lgs d. no 206/2005 and any further amendment)

1. Introduction and effectiveness of General Conditions

The following general conditions of sale (hereinafter referred as “General Conditions”) govern any purchase of goods and services made online on website (hereinafter referred as “the website”) pursuant to Italian law 206/2005 and any further amendment (hereinafter referred as “Consumer Code”).

Any customer who accesses to the website to make purchase of goods (hereinafter referred as “Customer” or “you”) is bound to read the following General Conditions prior to each order. The following General Conditions are available anytime and can be consulted and saved by the link included in the confirmation email.

2. Selection and Order of Goods

Properties and prices of goods available for sale in the website (hereinafter referred as “Items”, “Products” or “Goods”) are quoted on the web page of any item. For the purchase of goods you will be required to fill out the e-order form according to the instructions quoted on the web site. You place your items in the shopping cart and, having accepted the General Conditions and Privacy Policy, you specify your delivery and billing address and payment method, then pressing the checkout button your check out process is completed. Once you place your order, the purchase contract will be made and you are agreeing to the General Conditions hereby copied which will apply to any purchase made on this web site.

Completion of the contract between you and Prezzemolo & Vitale will take place with the acceptance of the order by Prezzemolo & Vitale. We will confirm acceptance of your order by sending a confirmation email including the General Conditions, order number, delivery and billing address, list of products you have ordered with general description and the total amount which includes the costs of delivery. You should check the confirmation email and – in the event there being any errors – you are entitled to bring them to the attention of Prezzemolo&Vitale Customer Care Centre using the following telephone number +39 0917219221 or by replying to the confirmation email, no longer than 6 hours after its reception. After this time no changes to your order will be accepted. Once you place your order, we will check the stock available of goods in order to confirm the acceptance of your order. Should some items be unavailable, Prezzemolo & Vitale Customer Care Centre will suddenly give to you notice via email – the customer is entitled to reply to it in order to delete or confirm the order, no longer than 6 hours after the reception of the email. After this time, your order will be delivered.

Should. Should few items be unavailable, all the items available from you order will be delivered. In any case, you will be refunded the cost of missing items according to the methods of payment you have chosen.

3. Information on Products

Any information on products and detailed barcodes are available on the website.

Product photographs shown, when available, on the website, correspond to its description. Let it be known that any product photograph only aims to show products supplied – they could differ from reality in certain respects such as colour and size.

Should exist any difference between photographs and their description, please rely on the latter.

4. Return Policy

You are entitled to cancel this contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services. Prezzemolo & Vitale Customer Care Service will arrange with you for the goods to be returned.

The right to return products is subject to the following conditions:

I. The products that are returned must not be used, worn, or damaged;

II. As soon as Prezzemolo & Vitale have ascertained that the required conditions for the returns have been met, they will send the Customer an email of confirmation accepting the returns and start the procedure for reimbursing the amount paid for the Products returned within 14 (fourteen) days, respective of the payment method adopted by the Customer, if not otherwise specified.

III. The products must be returned in their original packaging, together with any accessories or instruction manuals;

IV. Please note that your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

With referral to your right to return products, you accept that it does not apply to goods liable to deteriorate or expire rapidly such as food products (including wine, spirits and drinks) and cosmetic products. For health and hygiene reasons, please note that your right to return does apply only to products which can be resold afterwards (such as books, gadgets, utensils, etc.)

Should you return to us productsliable to deteriorate or expire rapidly, Prezzemolo & Vitale will return them to you. The cost of returning the goods will be your responsibility.

Customers are covered by our quality guarantee on every product. Should the customer not be entirely satisfied, Prezzemolo & Vitale will refund and replace any item subject to due compliance by the customer with these Terms and Conditions. 5. Faulty Goods

If you receive faulty goods, you should contact Prezzemolo & Vitale by email to We will promptly and fully refund the cost of any goods that do not meet with your reasonable satisfaction. We will arrange with you for the goods to be returned to us. We will provide a full refund for any goods that are damaged or defective, if this is within a reasonable time following the sale; or at your option, repair or replace the goods at our cost (including the cost of postage), unless this would not be possible or would be disproportionately costly in the circumstances, in which case we will refund to you the amount paid for the goods in question.

Please be aware that we ask that faulty goods are reported to us within two months. You are asked to return products liable to deteriorate or expire rapidly their use by date.

6. Liabilities

Prezzemolo & Vitale has taken every care in the preparation of the content of this website. However, to the extent permitted by applicable law, Prezzemolo & Vitale does not represent or warrant the accuracy or reliability of any of the information or content about any goods or services contained on, distributed through, or linked, downloaded or accessed from this website.

To the fullest extent permitted by applicable laws, Prezzemolo & Vitale hereby excludes liability for any claims, losses, demands, or damages of any kind whatsoever with respect to the website including, without limitation, direct, indirect, incidental, or consequential losses, or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Prezzemolo & Vitale. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. However, if you are a consumer your statutory rights are not affected.

Prezzemolo & Vitale will not selling any alcoholic drink to anyone who is not 16 years old or over. By placing an order you confirm that you are at least 16 years old.

Once the alcoholic drink has been delivered, it becomes the recipient’s liability.

8. Law and Jurisdiction

Purchase contracts between the Customer and Prezzemolo & Vitale shall be governed by, and construed in accordance with, Italian law. The parties irrevocably agree that the courts of Italy shall have exclusive jurisdiction to settle any dispute, which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the Italian courts.


Pursuant to the article 1341 c.c you acknowledge that you have read and agreed to abide by the terms described above and you are deemed to have entered into an agreement with Prezzemolo & Vitale.
